Secure goods or machinery in the estate

Document ownership, identity, location and payment flow for a separation review.

Goods or machinery owned by another party must remain clearly identifiable. Processing, attachment to other assets and every relocation are warning points because they may make factual identification and the separation review more difficult.

Section 44 IO in the current RIS text addresses assets in the estate that do not belong to the debtor and, where the statutory conditions are met, substitute separation. Whether those conditions are met requires review of the specific asset and evidence.

Processing, attachment, mixing, sale or relocation does not automatically determine the legal outcome. Each is a warning signal that should be documented immediately and assessed legally.
