Filing of a claim
The procedural step by which an insolvency creditor asserts a claim in the proceedings.
Under section 102 IO, insolvency creditors must assert their claims in the insolvency proceedings even where litigation is already pending. The claim basis, amount, evidence and court case details must therefore be assembled coherently.
Filing concerns a payment claim against the debtor. It is neither a request to separate third party property nor the later schedule status recording admission or dispute.
