We review the procedural status, contracts, payment records and security, then explain which legal question needs to be addressed next.
When a policyholder becomes insolvent and a loss occurs, the policy, premium and insurance benefit must be reviewed in their own time sequence. The policy alone does not show whether an unpaid premium, a claim against the insurer or an estate claim is involved.
The relevant points are the state of performance when proceedings opened, the insolvency administrator’s decision on the continuing contract and the date of the insured event. A payment by the insurer generally belongs to the policyholder’s legal sphere and should therefore be coordinated with the insolvency administrator.
This article deals only with insurance contracts of an insolvent policyholder. The insurer’s insolvency, employee claims and general questions of contract continuation are separate matters.
An insurance contract contains several duties. The insurer assumes the agreed risk. The policyholder owes the premium and must comply with contractual duties. When proceedings open, record what each side has already performed and what remains outstanding.
Where both sides still owe performance under a bilateral contract, section 21 IO may be relevant to the insolvency administrator’s decision. This is not an automatic rule for every policy. The policy type, insured event, due date and statement made in the proceedings must fit together.
A premium due before opening is not an estate claim simply because of its label. For premiums after opening, the basis on which the policy is continued for the estate must be assessed. The invoice, payment and administrator’s statement should therefore be kept in one file.
The notice first shows when and how the insurer learned of the insured event. Section 33 VersVG generally requires prompt notice. Under section 34 VersVG, the insurer may request information needed to establish the event and the extent of its duty to pay. Insolvency does not remove the need to provide that information in an orderly way.
For insolvency classification, the date of loss may not be enough on its own. A claim arising from a loss before opening may already form part of the debtor’s assets. A later loss also requires review of whether the policy remained in force, who administers it and which premiums were due.
Secure the notice, policy, conditions, expert report, invoices and insurer’s position. The complete file shows whether the benefit remains open as to liability or amount and which cooperation is still required.
The insurer should not simply pay the former management if the benefit belongs to the assets of the insolvent policyholder. The insolvency administrator reviews the allocation of the asset and the further handling of the claim. A different beneficiary, assignment or pledge may require a separate assessment.
The Insolvency Code distinguishes the claim itself from costs and obligations arising during the proceedings. Section 46 IO lists estate claims. Section 124 IO governs payment of established and due estate claims. This does not promise that an insurance benefit is immediately available or that a premium claim has the same rank.
Request the insurer’s written decision and record the intended payee. Where payment is refused or reduced, review the reasons, expert evidence and policy conditions together.
The basis on which a premium arose is decisive. A claim arising before opening from the policy may be an insolvency claim. An obligation created after opening by an act or by continuation of the policy by the administrator may require a different classification under the statutory conditions.
Where the estate is insufficient, statutory rules govern the rank and payment of estate claims. Section 47 IO provides groups and pro rata payment within the same group where full payment is impossible. The invoice date does not replace this review. Compare the premium period, due date, contractual statement and payments already made.
A four-column schedule is useful: insurance period, basis of claim, due date and procedural status. It shows which position is filed, disputed, paid from the estate or still open.
The insolvency administrator needs all policies, endorsements, premium accounts and open claim files. For each loss, record the date of the event, date of notice, policy number, affected asset and current position. Liability policies also require information about claimants and incoming letters.
Missing records can delay the cover review. This is particularly relevant for conditions, deductibles, exclusions, expert reports and proof of the loss amount. A short chronology supports communication with the insurer and prevents premiums and benefits from being mixed.
The portal’s guide on filing an insolvency claim addresses filing and disputes. The insolvency administrator glossary entry explains the role. Both links supplement, but do not replace, a review of the insurance file.
This depends on the policy, the insured event, any beneficiary designation and the insolvency classification of the asset. Payment should be coordinated with the insolvency administrator.
No. The basis, insurance period, due date and treatment of the continuing policy after opening must be assessed. Sections 46 and, where the estate is insufficient, 47 IO provide the statutory framework.
The policy and insurance conditions determine the duties that remain. Section 33 VersVG generally requires prompt notice. In practice, the insolvency administrator and insurer should be brought together quickly and the supporting records secured.
