Separate the ordinary claim route
If the opening was served or the claim was filed at the vote, the special route under section 197 IO is not established. Review the actual claim and procedural status under the rules that apply to that situation.

We review the procedural status, contracts, payment records and security, then explain which legal question needs to be addressed next.
A creditor who did not file the claim when a payment plan was voted on may have a special route. The condition is that the creditor was not notified of the opening of the insolvency proceedings. Section 197 IO then governs access to the payment plan quota and the limits on later enforcement.
The route depends on a precise chronology: opening of the insolvency proceedings, notification, voting and acceptance of the payment plan, and the point at which the claim first came to light. Lack of knowledge of the payment plan alone does not establish the statutory conditions.
This article deals only with an insolvency creditor who was not notified and did not file the claim at the payment plan vote under section 197 IO. Ordinary filing and a late filing under section 107 IO follow separate review paths.
Notification, filing, payment plan and court order must fit together in time.
| Review field | Evidence | Legal effect | Core question |
|---|---|---|---|
| Notification | Opening order, service record and file notes | The special claim depends on the absence of notification. | Was the opening actually served? |
| No filing | Schedule of claims, voting records and claim file | The claim must not have been filed at the payment plan vote. | Was the claim absent at the vote? |
| Quota and duration | Confirmed payment plan, acceptance date and duration | The quota covers the remaining duration and at least three years from acceptance. | Which period remains open? |
| Income and assets | Court order, income records and asset overview | The quota is limited to what corresponds to the debtor's economic position. | Which quota is supported by the file? |
| Enforcement | Order under section 197(2) IO and enforceability confirmation | Enforcement is permitted only within the scope of that order. | Is the court's preliminary decision available? |
The file must make the lack of notification and the absence of a filing at the payment plan vote traceable.
This check separates notification, non-filing, quota and the precondition for enforcement. It does not replace a review of the insolvency file.
Discuss the specific matter with the firm.
If the opening was served or the claim was filed at the vote, the special route under section 197 IO is not established. Review the actual claim and procedural status under the rules that apply to that situation.
Obtain the opening order, service record and any file notes. Service to the correct person and address is what answers the notification requirement in section 197 IO.
Compare the schedule of claims, voting records and the creditor file. The special route requires that the claim was not filed at the vote on the payment plan.
Section 197(2) IO provides for an application to the insolvency court concerning the quota for the claim that came to light later. Review the debtor's income and assets and the amount of the requested quota before planning enforcement.
Under section 197(3) IO, the enforcement application must include an authenticated copy of the order under subsection 2 together with confirmation of enforceability. Enforcement may cover only the quota and period addressed by that order.
Set out the acceptance date, payment plan duration and current income and asset position. If the statutory conditions are met, the claim concerns the plan quota for the remaining duration and reaches at least until three years after acceptance.
Bring together the opening order, service record, schedule of claims, payment plan, acceptance date and income and asset records in one chronology. This shows whether the quota order or another step must come first.
Section 197(1) IO attaches the entitlement to two facts. The claim must not have been filed at the vote on the payment plan. The insolvency creditor must also not have been notified of the opening of the insolvency proceedings. Without both conditions, the special rule does not support the claim.
It is therefore not enough that the creditor was unaware of the payment plan. The relevant notification concerns the opening of the proceedings. The opening order, service instruction, service record and address used at the time belong in the same file as the schedule of claims and the voting records.
A general late filing follows another path. A claim filed after the filing deadline is generally reviewed under section 107 IO. The article on a late insolvency claim deals with that route separately.
Where section 197(1) IO applies, the creditor is entitled to the quota payable under the payment plan. The entitlement is limited to the remaining duration of the plan. The statute also sets a minimum period: it reaches at least until three years after acceptance of the payment plan, even if the plan would otherwise end earlier.
The full quota is not fixed automatically. Section 197(1) IO additionally requires that it correspond to the debtor's income and assets. The confirmed plan, the acceptance date, the elapsed period and the current economic basis of the quota must therefore be secured for the calculation.
Section 156(4) IO remains unaffected. The special rule creates a route to the plan quota, while the other statutory effects and the actual file still require separate review.
The insolvency court makes a preliminary decision on application as to whether the quota for the claim that came to light later corresponds to the debtor's income and assets. This follows from section 197(2) IO. The application must connect the claim, payment plan, absence of notification and economic basis of the requested quota in a traceable way.
Section 156b IO describes the preliminary determination. If the existence or amount of the claim, or the shortfall on a partly secured claim, is disputed, the insolvency court may determine the probable amount on application. Section 156b(1) IO states that no appeal is available against this decision. The actual claim and later procedural position remain relevant for the final accounting.
The preliminary decision must be kept separate from the legal basis of the claim. It addresses the extent to which the quota corresponds to the debtor's economic position on the current file. It does not cure missing evidence about notification, non-filing or the payment plan acceptance date.
Section 197(3) IO limits enforcement for a creditor who did not file the claim. Enforcement may take place only to the extent that an order under subsection 2 has been made. The creditor must attach an authenticated copy of that order and confirmation of enforceability to the enforcement application.
The provision contains an alternative statement for a case in which the creditor did file the claim. For the special route addressed here, it is therefore essential that the court order actually concerns the unnotified, non-filing creditor and covers the quota and period relied upon.
If enforcement is authorised contrary to this requirement, it must be discontinued ex officio or on application without hearing the parties. Before filing, compare the order, confirmation of enforceability, payment plan and calculation of the outstanding quota.
The first page of the file should list the decisive dates in order: opening of the insolvency proceedings, attempted or absent notification, origin and knowledge of the claim, vote and acceptance of the payment plan, payments already made and the application under section 197(2) IO. This order prevents a lack of notification from being confused with later knowledge of the plan.
The confirmed payment plan, quota calculations, relevant income records and a clear asset overview support the economic limitation. The court's preliminary order and confirmation of enforceability are added when enforcement is being considered.
The payment plan overview explains the general review of quota, duration and confirmation. The section 197 IO route begins with the additional question whether this creditor was left without notification of the insolvency opening.
No. Section 197(1) IO requires that the claim was not filed at the vote and that the creditor was not notified of the opening of the insolvency proceedings. Later lack of knowledge of the payment plan does not replace proof about service of the opening.
If the conditions are met, the issue is the quota payable under the payment plan. It is limited to the remaining duration and reaches at least until three years after acceptance of the plan. It must also correspond to the debtor's income and assets.
Under section 197(2) IO, the insolvency court makes a preliminary decision on application as to whether the quota for the later-discovered claim corresponds to the debtor's income and assets. Section 156b IO provides the related preliminary determination framework.
No. For the special route addressed here, section 197(3) IO requires an order under subsection 2. The authenticated order and confirmation of enforceability must be attached, or the statutory alternative must be stated.
Enforcement authorised contrary to section 197(3) IO must be discontinued ex officio or on application without hearing the parties. Compare the order, confirmation of enforceability, payment plan and quota calculation before filing.
No. Section 197 IO concerns the special position of a creditor who did not file at the payment plan vote and was not notified of the opening. A late filing is reviewed under section 107 IO with its own procedural and cost consequences.
