Insolvency estate

The assets subject to the insolvency proceedings and relevant to administration, realisation and creditor satisfaction.

In brief

The insolvency estate comprises the assets subject to the opened insolvency proceedings. It is the economic reference point for administration, realisation and creditor satisfaction. Whether a particular asset belongs to the estate may depend on ownership, security and separation rights.

The estate is neither the insolvency administrator nor the body of insolvency creditors. The administrator acts as office holder in relation to the estate, while creditors pursue claims. The creditors topic hub distinguishes claims, ownership and security.
